What forms do I need to file for payroll taxes?

The main federal forms are Form 941, Form 940, W-2s, and W-3. In Michigan, you also file unemployment and withholding reports with the state.

Form 941 is the quarterly report for federal income tax withheld plus Social Security and Medicare taxes. You file it four times a year by April 30, July 31, October 31, and January 31. This reports what you withheld from employee paychecks and your employer portion of payroll taxes.

Form 940 is the annual federal unemployment tax return. You file it once a year by January 31 for the prior year. The effective rate is low if you paid your state unemployment taxes on time, but you still have to file it.

W-2 forms go to each employee by January 31, showing their total wages and withholdings for the year. Form W-3 summarizes all the W-2s and gets filed with the Social Security Administration along with copies of each W-2.

Michigan has its own requirements on top of federal filings. Quarterly wage reports go to the Unemployment Insurance Agency, reporting wages paid to each employee and calculating your state unemployment tax. Due dates match the federal quarterly schedule.

Michigan withholding tax returns are filed separately from unemployment. Depending on how much you withhold, you might file monthly or quarterly. Smaller employers typically file quarterly with an annual reconciliation on Form 5081.

If you pay independent contractors $600 or more during the year, you need 1099-NEC forms. These go to the contractor and the IRS by January 31. Many businesses forget about 1099s until the deadline is past and penalties start adding up.

The filing requirements are straightforward once you know the schedule. But missing deadlines triggers penalties immediately. Late 941 filings can result in penalties from 2% to 15% of the tax due depending on how late you are. Deposit penalties are separate and can be even steeper.

Most businesses use payroll processing software or services to handle these filings. The software generates forms and can file them electronically. Manual payroll means tracking every deadline yourself and hoping you don’t miss one.
